What is Bill 16?
Bill 16 (Loi 16) is a Quebec law adopted in 2019 that reforms condo management. It requires syndicates to maintain a maintenance logbook (carnet d'entretien), conduct a contingency fund study (étude du fonds de prévoyance) every 5 years, and provide an attestation to buyers showing the building's condition. The regulation came into force on August 14, 2025.
When do we need to comply with Bill 16?
Syndicates have until August 14, 2028 (3 years from the regulation's effective date) to complete their first compliant maintenance logbook and contingency fund study.
Does Bill 16 apply to small buildings (plex)?
Yes. Bill 16 applies to ALL divided co-ownerships (copropriétés divises) in Quebec, regardless of size. Even a converted duplex with 2 units must comply.
Who can prepare the maintenance logbook and contingency fund study?
These documents must be prepared by an independent professional from one of these orders: OIQ (Ordre des ingénieurs du Québec), OAQ (Ordre des architectes du Québec), OTPQ (Ordre des technologues professionnels du Québec), or OEAQ (Ordre des évaluateurs agréés du Québec). The professional must be independent (not a board member, manager, co-owner, or resident).
What happens if we don't comply with Bill 16?
Non-compliant buildings may face serious consequences: difficulty selling units (buyers won't have required attestation), difficulty obtaining financing (banks may refuse mortgages), difficulty obtaining insurance, and potential legal liability for board members.
