Article 1043 defines common portions for restricted use (PCUR): common portions whose use is reserved to one or more specified co-owners, such as a balcony, a terrace, an assigned parking space or a locker.

What it means for your syndicate

A PCUR is a hybrid category: the property remains the undivided property of all the co-owners, but its use is reserved to a subset. Its maintenance is the syndicate's responsibility.

The financial consequence is in article 1064 CCQ: only the co-owners who benefit from the restricted use contribute to the resulting expenses.

A PCUR must be designated in the declaration of co-ownership; it is not inferred from actual use. CondoAide links each PCUR to its beneficiaries and charges them the corresponding expenses.
