Article 1089 CCQ - Quorum of the meeting

Article 1089 sets the quorum of the meeting of co-owners: it can deliberate only if co-owners holding a majority of the votes are present or represented. Failing that, the meeting is adjourned to a later date, of which the co-owners are notified.

What it means for your syndicate

At the adjourned meeting the quorum is reduced: co-owners present or represented holding three quarters of that group's votes are enough - except for article 1097 CCQ decisions, which then require co-owners representing at least a majority of all the votes.

If quorum is lost during the sitting, the meeting must be adjourned as soon as any co-owner asks. Measuring quorum continuously therefore matters.
