Article 1041 CCQ - Relative value of the fraction

Article 1041 sets the relative value of each fraction against all the fractions together, taking into account their nature, destination, dimensions and location, but not their use. It is the default key for allocating common expenses.

What it means for your syndicate

The relative value is neither the floor area, the purchase price nor the number of rooms: it is set in the declaration of co-ownership and serves as the basis for calculating each share (art. 1064 CCQ).

The relative values of all fractions add up to 100%. Changing one requires amending the constituting act of co-ownership, an enhanced-majority decision (art. 1097 CCQ).
