Article 1099 CCQ - Reduction of the number of votes

Article 1099 provides that when the number of votes of a co-owner or of a promoter is reduced, or when they are deprived of their voting right, the total number of votes of all the co-owners is reduced accordingly.

This rule keeps the vote caps (for example those limiting a majority co-owner or a promoter) and the loss of voting rights for arrears coherent: the removed votes are not redistributed to the others.

The denominator used to calculate majorities decreases accordingly, which avoids distorting the thresholds to be reached at the meeting.
