Article 1466 CCQ - Liability of the owner of an animal
Article 1466 makes the owner of an animal liable for injury it causes, whether it was in their custody or a third person’s, or had strayed or escaped. A person using the animal is also liable, together with the owner, during that time.
What it means for your syndicate
The liability is strict: the owner is not released by proving they committed no fault. Only an outside cause, such as the victim’s fault or superior force, can relieve them in whole or in part.
In a co-ownership, the syndicate may therefore claim from a co-owner (art. 1074.2) for damage their animal caused to the building, for example a damaged floor or door. If the animal belongs to a tenant, the claim goes to the tenant.
