Article 2724 CCQ - The syndicate's legal hypothec

Article 2724 lists the only claims that may give rise to a legal hypothec. The claim of a syndicate of co-owners for payment of the common expenses is one of them, giving the syndicate a security on the fraction of a defaulting co-owner.

What it means for your syndicate

This legal hypothec is a significant collection lever: it charges the fraction of a co-owner who has been in default of paying their share of the common expenses for more than 30 days (art. 2729 CCQ).

It is acquired only upon registration of a notice in the land register stating the nature of the claim and the amounts. Registration is a legal proceeding: a notary or lawyer should be consulted.
