Since August 14, 2025, article 1068.1 requires the syndicate to provide the selling co-owner with a certificate on the state of the co-ownership intended for the buyer, within 15 days of the request. Its content is prescribed by Decree 991-2025.
The certificate informs the buyer about the syndicate's financial situation, the contributions, ongoing proceedings and litigation, planned major work and insurance. It is prepared by the syndicate, not necessarily by a notary.
Gathering this up-to-date information from the register and the financial statements is the main practical challenge of the obligation.
