Sale process: one file per sale, from the attestation request to the buyer's arrival

Every unit sale has its own file, which follows the steps in the order of the law with their deadlines: the syndicate attestation, the statement of common expenses due, the prospective buyer's documents, the change of owner and the new co-owner's invitation.

A unit sale puts several deadlines in front of the board at once: 15 days for the syndicate attestation, 15 days for the statement of common expenses due, documents to provide to the prospective buyer, then the change of owner to record in the register. Each request arrived through a different channel, and nothing tied them together.

One sale, one file

"Sale process", in the menu, gathers the sales in progress, each with its current step and its next deadline. A file opens on its own as soon as an attestation or a statement of common expenses is requested for a unit, or a change of owner is recorded. The board can also open one when a sale is announced, with "Open a file".

The menu flags the sales with a deadline that is close or past.

The steps, in the order of the law

The file lists the steps with the article that requires them, and each step leads to the screen that does it:

  1. Syndicate attestation (art. 1068.1 C.C.Q.), to give the selling co-owner within 15 days of the request.
  2. Attestation fee, if the building's by-laws provide for one: the invoice is issued when the attestation is finalized.
  3. Statement of common expenses due (art. 1069 C.C.Q.).
  4. Documents requested by the prospective buyer (art. 1068.2 C.C.Q.), with the request date, the date sent and the copy given to the owner.
  5. Change of owner (art. 1065 C.C.Q.), to record on the date the deed of sale is signed.
  6. Pre-authorized debit mandate: the seller's mandate ends, and the buyer is invited to sign their own.
  7. Buyer's arrival: each new owner is invited to join the syndicate.

Steps 1 to 4 apply only if someone asks for them. "Record the delivery" notes the day the attestation was handed to the seller, which stops the 15-day clock.

The sale file for unit 012: the prospective buyer, the broker and the notary, the seven steps with their Civil Code article, and what stays attached to the unit

The file also keeps the parties and the dates (the prospective buyer, the broker, the notary, the promise to purchase and the expected signing) and shows, for information, what stays attached to the unit: the balance owing, open work authorizations and contravention notices relevant to the buyer. Once the steps are done, "Close the sale" closes the file.

The seller can request the attestation

A co-owner who is selling can request the syndicate attestation from their own space, and name their broker or notary. The request reaches the board along with the matching sale, and "Produce the attestation" prepares it for the right unit.

Deadlines are calculated from the dates entered. Meeting the Civil Code's deadlines remains the board's responsibility.
